Ex-MMA fighter loses jailhouse assault appeal

But while he held sway inside the jail, his position wasnโt enough to overturn a conviction for beating up a fellow inmate who challenged him.
Primmer, 34, a former mixed martial arts fighter who was deemed a dangerous offender in a London courtroom almost a year ago, lost an appeal of an 18-month sentence for assault at the Ontario Court of Appeal, a crime that revealed some of the rules of the jail and Primmerโs own innate violence.
He had claimed self-defence and politely vowed to appeal the guilty decision when he was sentenced in the Ontario Court of Justice in 2015.

Then Primmer walked across the room and punched the fellow inmate in the head 25 to 30 times. The guards quickly broke up the attack.
The Ontario Court of Appeal upheld the decision by Justice Thomas McKay that the attack wasnโt in self-defence, despite the inmateโs code โwhich required the appellant to use force to respond to the complainantโs challenge or face at some point a violent attack from the complainant or the other inmates.โ
Primmer had contended that the man he attacked had called him a child molester and made a threat. He had no choice but to attack to maintain his high standing in the pecking order.
โThe reasons of the trial judge demonstrate that he did take the prison context into account but that he found that the Crown had proved beyond a reasonable doubt that the legal elements of self-defence were not met,โ the appeal court wrote in its decision to dismiss the appeal.
Primmer was found to be a dangerous offender in May after he was convicted of a vicious attack on a former girlfriend where he cut her arms, took photos of her injuries and beat her for not having sex with one of his friends when they ran out of cocaine.
On his criminal record were 47 convictions for violent acts, including a conviction for manslaughter when he was 18 and living in Stratford.
He was convicted for the 2013 assault on Desiree Gallagher, 23, of Brantford, who suffered catastrophic injuries after falling from a seventh floor balcony at Primmerโs apartment building.
Primmer wasnโt charged for the fall, but for the assault documented in photos he took of Gallagher that were found on his cellphone.
There were other assaults on women after he served that sentence.
Gallagher died in 2015.
When he was declared a dangerous offender, Superior Court Justice Alissa Mitchell called him โa habitual liarโ who is a very high risk to re-offend.
